Terms of service

These Terms of Service ("Terms") are a binding agreement between you and Amigoo Ltd, a company registered in England and Wales ("Amigoo", "we", "us", "our"). They govern your access to and use of www.amigoo.co.uk, amigoo.co.uk and the Amigoo applications, including all AI characters, chats, lessons, challenges, voice features and subscription plans (the "Service").
By creating an account or otherwise using the Service you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 13 years old (or 16 where required by local law) to use the Service. If you are under the legal age of majority in your country, you must have your parent or guardian's permission. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.
2. Your account
You agree to provide accurate information, to keep your credentials secure, and to be responsible for all activity under your account. Notify us immediately of any unauthorised access. We may suspend or terminate accounts that violate these Terms or applicable law.
3. The AI characters
All Amigoo characters — including Manuel, Sofía, Carlos, Valentina, Beatriz, Rafael, Giulia, Lorenzo, Marie, Lucas, Anna, Stefan, Eleni and Yiannis — are fictional personas powered by large language models. They are not real people, are not licensed teachers, and are not a substitute for professional, medical, legal, financial or psychological advice. Their replies may be inaccurate, outdated or incomplete. You must use your own judgement and verify important information independently.
4. Acceptable use
You agree not to, and not to allow anyone else to:
- Use the Service for any unlawful, harmful, harassing, defamatory, sexually exploitative, or fraudulent purpose.
- Send content that abuses, threatens or sexualises minors or any real person.
- Attempt to extract, reverse-engineer or replicate the underlying AI models, prompts or training data.
- Scrape, mass-download, or use automated systems against the Service without our written permission.
- Resell, sublicense or share account access with others.
- Interfere with security, rate limits or integrity of the Service.
We may, at our sole discretion, remove content, suspend features or terminate accounts that breach this section.
5. Subscriptions and payments
Amigoo offers a free Starter plan and paid Pro and Premium plans. Paid plans renew automatically at the end of each billing period (monthly or yearly) at the then-current price. Payments are processed by Stripe. You can cancel renewal at any time from your account; cancellation takes effect at the end of the current paid period. Except where required by law, payments are non-refundable.
UK consumers have a 14-day right to cancel under the Consumer Contracts Regulations. By starting to use paid features within that period you expressly request immediate performance and acknowledge that you lose the right to cancel once the service has been fully performed.
6. Plan limits
Each plan includes the messaging, character access, saved-word and lesson allowances listed on our pricing page. We may reasonably adjust allowances and features over time. Material reductions to a paid plan will be communicated in advance.
7. Intellectual property
The Service, including its software, design, characters, audio, logos and content, is owned by Amigoo Ltd or our licensors and is protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable licence to use the Service for your own language learning.
You retain ownership of the messages you create. By submitting content you grant Amigoo a worldwide, royalty-free licence to host, process and display that content as necessary to operate, secure and improve the Service.
8. Third-party services
The Service uses third-party processors (including Supabase, Stripe, ElevenLabs and AI model providers) as described in our Privacy Policy. We are not responsible for the content or practices of third-party services that you choose to connect.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory or otherwise, including any warranty of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure or that AI replies will be accurate.
10. Limitation of liability
To the maximum extent permitted by law, Amigoo's total aggregate liability arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) £50. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.
11. Indemnity
You agree to indemnify and hold harmless Amigoo Ltd, its officers, employees and agents from any claims, damages, liabilities and expenses arising out of your breach of these Terms or your misuse of the Service.
12. Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate your access immediately for breach of these Terms, suspected fraud, or to comply with law. On termination your right to use the Service ends; sections that by their nature should survive (including IP, disclaimers, liability, indemnity and dispute resolution) will survive.
13. Changes to the Service or Terms
We may update, change or discontinue features of the Service at any time. We may also amend these Terms; material changes will be notified in-app or by email at least 14 days before they take effect. Continued use after that date means you accept the updated Terms.
14. Governing law and disputes
These Terms and any dispute or claim arising out of them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in the EU, you may also bring proceedings in the courts of your country of residence.
